DMCA Takedown Policy

MODERA respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.
DMCA Notice Requirements
If you are a copyright owner or authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to dmca@modera.fashion, with the following information:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing and where it is located on the Service
- Your contact information (email address and phone number)
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law
- A statement, made under penalty of perjury, that the above information is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner
Counter-Notice Procedures
If you believe your content was incorrectly removed due to a mistake or misidentification, you can send a counter-notice to our designated agent containing the following information:
- Your physical or electronic signature
- Identification of the content that has been removed and the location where it appeared
- A statement under penalty of perjury that you have a good faith belief that the content was removed by mistake or misidentification
- Your name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the federal court in the district where you reside
- A statement that you will accept service of process from the person who filed the original DMCA notice
Warning
If you knowingly materially misrepresent that material was removed or disabled by mistake or misidentification, you may be liable for damages, including costs and attorney's fees.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability.
Repeat Infringers
MODERA maintains a policy of terminating the accounts of repeat infringers. A user's account will be terminated if they receive multiple DMCA takedown notices or copyright strikes. We reserve the right to terminate accounts that we determine to be repeat infringers in our sole discretion.
Changes to This Policy
MODERA reserves the right to update or modify this DMCA Takedown Policy at any time and from time to time without prior notice. Any changes to this policy will be posted on this page with an updated revision date.
